MCX acquired by Villar-led company for P3.8 billion

Supreme Court issues TRO against No-Contact Apprehension Policy (NCAP) and sets January 2023 oral arguments

To those of you motorists who got penalized over alleged violations of the No-Contact Apprehension Policy (NCAP) implemented by some local government units (LGUs), be aware that the Supreme Court has issued a temporary restraining order (TRO) against the said police and scheduled oral arguments on January 2023, according to a GMA Network news report. Also be aware that certain Metro Manila city mayors are standing firm with the NCAP.

To put things in perspective, posted below is the excerpt from the GMA news report. Some parts in boldface…

The Supreme Court on Tuesday issued a temporary restraining order (TRO) against the No-Contact Apprehension Policy (NCAP) being implemented by local government units.

In a media briefer, the SC said effective immediately, any apprehensions through the NCAP programs and ordinances related to the policy shall be prohibited until further orders from the court.

It also enjoined the Land Transportation Office and all parties acting on its behalf from giving out motorist information to all local government units, cities, and municipalities enforcing NCAP programs and ordinances.

The SC set the oral arguments on the issue on January 24, 2023.

The SC’s order came after transport groups Kapit, Pasang Masda, Altodap, and the Alliance of Concerned Transport Organizations filed a petition against local ordinances related to NCAP in five cities in Metro Manila.

A lawyer also asked the high court to declare as unconstitutional and issue a TRO against Manila City Ordinance No. 8676, which implements the policy.

For its part, the LTO has previously asked local governments to temporarily suspend the implementation of the policy, with its head, Teofilo Guadiz III, calling on the mayors of the five cities to sit down with the LTO and the Metropolitan Manila Development Authority (MMDA) to create uniform guidelines.

To this day, the NCAP is controversial and anyone who got charged for traffic-related violations can challenge the findings through due process. There was this case of the road trap in Parañaque City that affected a lot of motorists with penalties for alleged disregarding of traffic signs. For insight, posted below is an excerpt from a Motopinas.com article about Parañaque’s road trap. Some parts in boldface…

For the many motorcycle riders who reside in Las Pinas and Cavite, going to Manila or Quezon City meant passing through Paranaque City’s Dr. Arcadio Santos Avenue (Sucat RD) toward Domestic Road on the way to EDSA, or toward Macapagal BLVD and Roxas BLVD.

A few weeks ago, road users were in an uproar on what they dubbed as “road trap” in one of the intersections of the said thoroughfare.

On this particular intersection of J.P. Rizal and Sucat RD, the second lane was marked with an arrow for left-turning vehicles only. Since Paranaque City is one of the few Metro Manila cities that implement a No-Contact Apprehension System, hundreds of drivers and motorcycle riders were summoned with their corresponding traffic violation which amounts to PHP 1,500 for Disregarding Traffic Signs (DTS).

What’s odd is that the marking was previously pointing north towards the former Nayong Pilipino and not to the left.

With fuel costs nearing PHP 100/liter, every penny counts for the Juan dela Cruz rider/driver, and penalties from similar traffic violations could mean a family skipping lunch or dinner.

Just recently, a motorcyclist was summoned by the city for DTS. The motorcycle rider sought help from the Motorcycle Rights Organization (MRO), who then advised what steps should be taken following due process of law.

According to MRO, based on their research of relevant laws, LGUs like Paranaque City cannot make a new or update a road marking/traffic sign without prior approval from the Department of Public Works and Highways (DPWH) or the Department of Transportation (DOTr)/ Land Transportation Office (LTO).

To follow due process, MRO advised the rider to first seek a reaction/memo from the DPWH as to the legality of the road/traffic markings. The DPWH has then sent a letter to Paranaque LGU advising them that the marking is inconsistent with current standards. You can view the MRO social media post here.

On their end, the City of Paranaque has made the necessary lane marking corrections and has declared the motorcycle rider’s traffic violation void.

For added insight about Parañaque, watch the video below.

Let me end this piece by asking you readers: What is your reaction to this new development? If you were charged for traffic violations based on findings through the NCAP system, which particular local government unit penalize you? Do you believe that the NCAP system is being abused by LGUs as a means to raise internal revenues at the expense of motorists who were tagged for traffic violations? Did Parañaque City’s notorious road trap get you penalized? Do you believe that the NCAP made traffic flow and road discipline better? Do you believe that the NCAP implemented by the cities of Parañaque, Valenzuela, San Juan, Manila and Quezon City should be declared illegal by the Supreme Court?

Do you believe that the city governments of Parañaque, Valenzuela, San Juan, Manila and Quezon City should be compelled to reveal how much many they each raised from all the penalties collected through NCAP?

Get ready for the “Build, Better, More” infrastructure program

If there is something highly significant done by the previous administration under former Philippine President Rodrigo Duterte that a lot of people will benefit from, it would be the “Build Build Build” infrastructure program which was designed to grow the economy, reduce poverty and solve congestion. This resulted in expansion and improvements through projects on roads, bridges, highways, airports and also water resources. For more on the impact of “Build Build Build”, click here and here.

Of course, the 6-year term of Duterte was ultimately insufficient to complete all the projects of the program (note: the incomplete ones are still continuing) and now we have a new leader with President Ferdinand “Bongbong” Marcos, Jr., who specifically mentioned infrastructure during his State of the Nation Address (SONA).

Yesterday, it was reported by the Manila Bulletin that a new infrastructure program under the Marcos administration has officially been announced as “Build, Better, More”. Other than the name, there are notable details listed which will give people a clear idea about what to expect about the continued development of Philippine infrastructure.

To put things in perspective, posted below is the excerpt from the Manila Bulletin news report. Some parts in boldface…

“Build, Better, More”–or BBM for short–is officially a program of the Marcos administration, and the executive branch is asking P1.196 trillion from Congress in order to fund it next year.

Department of Budget and Management (DBM) Secretary Amenah Pangandaman acknowledged during a press conference with House reporters Monday, Aug. 22 that the BBM program was an “expansion” of the previous Duterte administration’s “Build, Build, Build” infrastructure modernization initiative.

BBM is also the initials of the incumbent President Ferdinand “Bongbong” Marcos Jr.

The BBM program was listed as a “spending priority” on the DBM’s briefer on the 2023 National Expenditure Program (NEP), which the agency submitted to the House of Representatives Monday.

A total of P1.196 trillion has been allocated for the government’s 2023 infrastructure programs,” read a statement from DBM, referring to the budget being sought from lawmakers.

“The Department of Public Works and Highways (DPWH) will receive [a] P718.4-[billion] budget in 2023, while the Department of Transportation will receive P167.1 [billion] in 2023–an increase by 120.4 percent for its P75.8-[billion] budget in 2022, which covers the augmented funding requirements for various foreign assisted railway projects,” it stated.

Pangandaman said during the presser that BBM includes “convergence programs with Department of Tourism, Department of Education, Department of Agriculture, and Department of Trade and Industry”.

“Related po doon sa Build, Better, More program natin (Related to our Build, Better, More program), which is an expansion of the Build, Build, Build program are programs po under the DOTr,” the DBM chief noted.

Among the major transportation infrastructure projects that will be implemented include the North-South Commuter Railway (costing P75.1 billion), Metro Manila Subway Project (P26.3 billion), and Light Rail Transit (LRT) Line 1 Cavite Extension Project (P2.7 billion).

Also linked to the BBM program are more specific infrastructure initiatives such as the Network Development Program (P140.4 billion), Asset Preservation Program (P88.5 billion), and Bridge Program (P38 billion).

Pangandaman said that the Network Development Program’s purpose is to “expand the connectivity and road systems across the country”. On the other hand, the Asset Preservation Program involves “maintenance, rehabilitation, and reconstruction”.

“We also have the Bridge Program po, [the] construction and maintenance and repair of bridges,” she added.

In his State of the Nation Address (SONA) last July 25, Marcos said, “The backbone of an economy is its infrastructure. The infrastructure program of the Duterte administration must not only continue but, whenever possible, be expanded. We shall confidently build on this firm foundation established by my predecessor. As it is in building an edifice, we must keep the momentum and aspire to Build Better More.”

The 2023 NEP, which is the precursor of the General Appropriations Bill (GAB) or proposed national budget, will be scrutinized first in the House of Representatives. It will eventually endorse to the Senate its GAB after they approve it on third and final reading.

Regardless of who is in-charge in the national government, I personally favor the widespread, massive development of infrastructure projects around the country. In my honest opinion, improved and expanded infrastructure will pave way for better economic growth covering vast sectors like industry, commerce, tourism, real estate, agriculture and more. The past Build, Build, Build and the new Build, Better, More are clearly more than just about solving traffic congestion. The Marcos administration now has the task of implementing the new infrastructure program which will not only improve infrastructure but also create new jobs.

Let me end this piece by asking you readers: What is your reaction to this recent development? Are you glad that President Marcos and his administration are focused on continuing the momentum of massive infrastructure development that his predecessor started? What kind infrastructure projects would you want the nation government to start working on?

420-kilometer SLEX toll road approved

Traveling south along the South Luzon Expressway (SLEX) will lead to more destinations faster as the Department of Transportation (DOTr) and other stakeholders approved the SLEX TR5 (South Luzon Expressway Toll Road 5) which is over 400 kilometers long, according to a Malaya news report. The said toll road stretches from Lucena, Quezon province to Matnog, Sorsogon.

To put things in perspective, posted below is the excerpt from the Malaya news report. Some parts in boldface…

The Department of Transportation (DOTr), along with other government agencies, has given the green light for the 420-kilometer South Luzon Expressway Toll Road 5 (SLEX TR5) from Lucena, Quezon to Matnog, Sorsogon.

The supplemental toll operations agreement was signed last June 3, almost two years after the Toll Regulatory Board (TRB) designated San Miguel Corp.’s proposal as a certified toll road project.

The agreement was signed by the DOTr, TRB, Department of Public Works and Highways (DPWH) and San Miguel Holdings Corp. (SMHC), and will be submitted to the Office of the President for approval.

As a toll road project, SLEX TR5 will involve various activities such as a right-of-way acquisition and construction, among others.

According to the TRB and the toll concessionaire, SLEX TR5 will connect Quezon and the provinces in Bicol. It is also expected to provide better and safer access to the tourism destinations, roll-on roll-off ports and fish ports in the provinces as well as address the traffic congestion in Bicol Region.

The TR5 is a four-lane divided toll road that starts from the terminal point of the SLEX TR4 project at Barangay Mayao, Lucena City in Quezon and ends at Matnog in Sorsogon near the Matnog Ferry Terminal.

SLEX TR5 is composed of eight segments which will run parallel to the existing Philippine National Railways, Maharlika Highway and Padre Burgos National Road or Quirino Highway.

The first segment is a 59.6-km. expressway from Lucena to Gumaca in Quezon that is estimated to cost P22.6 billion. Segment 1 is expected to be completed within 24 months, according to the DPWH.

Let me end this piece by asking you readers: What is your reaction to this new development? Once the toll road is completed, do you intend to travel far further south?

COVID-19 Crisis: Construction of 36-bed modular hospital in Las Piñas City progressing

According to a Manila Bulletin news report, the construction of a modular hospital designed to provide additional bed space as part of the Las Piñas General Hospital and Satellite Trauma Center (LPGH-STC) in Barangay Pulanglupa 1 in Las Piñas City is progressing and the Department of Public Works and Highways (DPWH) is involved. The said project was inspected recently by DPWH Secretary Mark Villar and his sister Las Piñas City Representative Camille Villar.

What exactly will the new project do in relation to the COVID-19 crisis and the City of Las Piñas? To put things in perspective, posted below is an excerpt from the news report. Some parts in boldface…

Department of Public Works and Highways (DPWH) Secretary Mark A. Villar recently inspected the ongoing construction of a modular hospital being undertaken by the DPWH to aid in the coronavirus disease (COVID-19) program of Las Piñas City.

Villar, together with his sister and Las Piñas Rep. Camille A. Villar, checked the project which is being implemented inside the Las Piñas General Hospital and Satellite Trauma Center (LPGH-STC) at the Bernabe Compound, Diego Cera Ave, Pulanglupa I.

“Our team from the DPWH Las Piñas-Muntinlupa District Engineering Office has so far accomplished 90 percent of the facility complete with ventilation systems, oxygen lines, and air condition units,” said Secretary Villar.

“We are building a modular hospital capable of accommodating 36 COVID-19 patients. This will hopefully bring relief, decongesting the existing facilities of LPGH-STC so they can focus on treating severe cases or other non-COVID-19 patients,” said Secretary Villar.

The report ended by stating that the new modular hospital is expected to not only be completed but also open today – June 24, 2021. Its construction began in April 2021.

Any Las Piñas resident who has yet to get registered for free COVID-19 vaccines can learn the ways (4 methods) of registration by clicking here. Anyone who is ready and willing to register online can click bit.ly/LasPiñasVaccination

Let me end this piece by asking you readers: Does this new facility make you feel confident about the city’s pandemic efforts?

Skyway Stage 3 Quirino southbound exit now open to motorists

Hey readers! Have you been driving along Skyway Stage 3 lately? In case you missed the news, the southbound Quirino exit of Skyway Stage 3 was officially opened this past Monday. To be specific, it allows motorists from Balintawak and Quezon Avenue to travel to Manila much faster and safer than before.

In a May 24, 2021 Facebook page post, San Miguel Corporation president Ramon S. Ang wrote: Together with the DPWH, we opened today the Quirino southbound exit of Skyway Stage 3. This will cut travel time from Balintawak and Quezon Ave. to Manila to less than 20 mins from the usual 1.5 hours. In the midst of the pandemic, we remain committed to delivering sustainable infrastructure that will ensure better lives for the present and future generations. This is the world we want.

The Quirino exit on the southbound lane of Skyway Stage 3 formally opened. (source – Ramon S. Ang Facebook page)

To put things in perspective some more, posted below is an excerpt from the Philippine News Agency (PNA) article about the same subject matter. Some parts in boldface…

San Miguel Corporation (SMC), through SMC Infrastructure, opened Monday the southbound Quirino exit of the Skyway Stage 3 elevated expressway to Class-1 vehicles, allowing motorists coming from Balintawak and Quezon Avenue to directly reach Manila within less than 20 minutes from 1.5 hours without traffic.

The opening was led by Department of Public Works and Highways (DPWH) Secretary Mark Villar and SMC president Ramon S. Ang.

“The full completion of Skyway Stage 3 will divert at least 75,000 vehicles away from EDSA or C5. This is a realization of President Duterte’s promise to decongest EDSA. Skyway Stage 3 is proof that the private sector and the government can work together towards a unified solution,” Villar said.

Ang said the opening of the Quirino southbound exit will greatly improve accessibility from Quezon City and Manila.

“With more private vehicles diverted to Skyway Stage 3 on their way back from NLEX (North Luzon Expressway), or coming from Quezon Avenue, to Manila, traffic on our major public roads as well as on streets usually utilized as ‘shortcuts’ or ‘alternate routes’, will be a thing of the past. This will redound to relief from congestion and faster and easier commutes for many of our countrymen on our major thoroughfares. We thank President Duterte and the government team led by Secretary Villar for all their support,” he said.

And said SMC will continue to deliver on its commitment to bring motorists quality infrastructure that addresses congestion and lack of accessibility.

“We remain dedicated to providing convenient and seamless travel for motorists to help decongest Metro Manila and enable growth in all areas that we reach,” he added.

SMC, which fully-funded and built 100 percent of the Skyway Stage 3, said the expressway now has 15 operational ramps.

These include Northbound entry/on-ramps — Buendia (Zobel) and Quezon Avenue; Southbound entry/on ramps –Balintawak, Quezon Avenue and Plaza Dilao; Northbound exit/off ramps –Quirino Avenue, Nagtahan, Quezon Avenue, A. Bonifacio, and Balintawak; and Southbound exit/off ramps –Quezon Avenue, E. Rodriguez, Nagtahan, Quirino and Buendia (Zobel).

Now here is a related news video for your viewing pleasure and learning…

Let me end this piece by asking you readers: Have you traveled along Skyway Stage 3 and exited through Quirino already? If you did, what was the experience like? How fast did it take you to travel from Balintawak or Quezon Avenue to exit through Quirino? Is the southbound travel along Skyway Stage 3 even better now that the Quirino exit is open?

To all motorists based in Muntinlupa, Las Piñas and Parañaque, how often did you travel along Skyway Stage 3 this year?
