Warrantless arrest of vote-buyers and sellers included in new COMELEC resolution for 2025 elections

Anyone who gets caught selling or buying votes in connection with the National and Local elections this year will get into trouble as the Commission on Elections (COMELEC) recently issued a resolution monitoring such activities and warrantless arrests will be allowed, according to a GMA Network news report.

The Commission on Elections (COMELEC) has issued a resolution allowing law enforcement to arrest vote buyers and sellers without a warrant if they are caught in the act.

According to Sandra Aguinaldo’s report on “24 Oras,” Resolution No. 11104 will expand the authority of the poll body’s Committee on Kontra-Bigay” to monitor vote buying and selling in Eleksyon 2025.

The resolution allows a law enforcer to make a warrantless arrest if he or she witnessed an act or attempt to commit election offenses.

“Any law enforcement officer may, without a warrant, arrest a person when, in his or her presence, the person to be arrested has committed, is actually committing, or is attempting to commit the election offense of vote-buying and vote-selling or act constituting ASR (abuse of state resources),” the resolution read.

The arrested individual will be brought to the nearest police station.

Meanwhile, the materials used in vote buying or selling will be under the custody of the police.

“The money or any other goods of value, sample ballots and any other campaign materials used for vote-buying and vote-selling, and ASR, shall be immediately seized and taken into custody by the apprehending law enforcement officer,” the resolution added.

More than two-thirds of the participating voters of Las Piñas City approved the ordinance setting the territorial boundaries of the twenty barangays during the plebiscite this past Saturday which was handled by the Commission on Elections (COMELEC), according to a GMA Network news report. Specifically, 68% of the voters voted in favor of the proposal although COMELEC chairman George Garcia pointed out that the voter turnout was low.

Over 41,000 residents (67%) of Las Piñas City on Saturday voted in favor of an ordinance that sets the territorial boundaries of the 20 barangays in the city.

Based on the certificate of canvass of votes shared by Commission on Elections (Comelec) Chairman George Garcia to members of the media, 41,493 residents voted “yes” while 19,498 voted “no” when asked if they agree with delineating the territorial boundaries of the 20 barangays.

With this, the ordinance was proclaimed ratified and approved.

“Nanalo po ang ‘yes,’ and therefore epektibo na ang ordinansa tungkol sa pagliliwanag ng paghahati ng bawat barangay doon sa 20 barangays sa Las Piñas,” Garcia said in a Super Radyo dzBB interview.

(‘Yes’ won, and therefore the ordinance regarding the delineation of the division of each barangay in the 20 barangays in Las Piñas is now effective.)

He, however, lamented the low voter turnout which was only around 20%. Las Piñas City has a total of 308,059 registered voters, but only 61,237 voters actually voted in the plebiscite.

Ordinance No. 1941-23 Series of 2023 delineates the territorial boundaries of the 20 barangays in the city in accordance with the Department of Environment and Natural Resources’ cadastral survey that was completed in March 2015.

The ordinance states that since the creation of the barangays in 1978, “the territorial metes and bounds of the said barangays have not been properly identified such that there are barangays whose land areas are not contiguous and/or overlapping with another barangay.”

“Moreover, confusion in the territorial boundaries of the barangays is being encountered which could cause disputes, or be subject of disputes, especially since the cadastral mapping in 1980 for the barangays conflicted with the boundaries as set forth in the Presidential Decrees,” the ordinance added.

With the Barangay and Sangguniang Kabataan Elections (BSKE) all set to happen less than two weeks from now, the Commission on Elections’ (COMELEC) top officials recently visited Las Piñas City and conducted a related voting simulation at Robinsons Place, the City Government confirmed through its Facebook page.

In anticipation of the upcoming Barangay and Sangguniang Kabataan (SK) Elections set for October 30, the Commission on ElectionS (COMELEC) hosted a voting simulation exercise at the Robinson’s Mall in Las Piñas on Tuesday, October 17th. The event aimed to test the preparedness of both the electoral body and the voting public, as well as to identify any potential issues that could arise on election day.

Gracing the occasion were notable COMELEC officials including Chairman Atty. George Garcia, and Commissioners Nelson Celis and Atty. Rey Bulay. The simulation was a crucial step in ensuring that the electoral procedures are followed, and to make any necessary adjustments before the actual elections. In what seems to be an intention to ensure election integrity, the Commission on Elections (COMELEC) expressed that it is planning to allow warrantless arrest of persons who are caught buying or selling votes specifically during the campaign period, according to a GMA Network news report. Take note that this is related to the upcoming Barangay and Sangguniang Kabataan Elections (BSKE).

The Commision on Elections (Comelec) on Tuesday said it is planning to allow warrantless arrest for those who will be caught in the act of buying or selling votes during the campaign period.

In a press conference, Comelec chairperson George Garcia said the commission will issue new guidelines for the barangay and Sangguniang Kabataan elections (BSKE), which is set on October 30.

“Sa ilalabas naming guidelines bilang pahapyaw lang po, papayagan natin silang mag-aresto especially kung yung tao ay caught in flagrante or caught in the act. Dati wala po yun. Ngayon, i-authorize po namin siya with full backing of the Comelec because it is our belief that under our Constitution warrantless arrest is allowed,” said Garcia.

(In the guidelines that we will issue, we will allow the PNP to arrest if the person is caught in the act. We will authorize that now with full backing of the Comelec because it is our belief that under our Constitution warrantless arrest is allowed.)

Garcia said that the basis of the previous prohibition of arrest during the campaign period was the 1985 omnibus election code.

But under the 1987 Constitution, Garcia said warrantless arrest is allowed in cases of flagrante delicto or being caught in the act.

He pointed out that if there is a contradiction between existing law and the Constitution, the Constitution will be followed.

Recently, the Commission on Elections (COMELEC) announced that the filing of Certificates of Candidacy (COCs) for this year’s Barangay and Sangguniang Kabataan Elections (BSKE) will start on July 3 until July 7, 2023, according to a Philippine News Agency (PNA) report. The BSKE itself will happen on October 30, 2023.

Filing of Certificates of Candidacy (COCs) for the Oct. 30 Barangay and Sangguniang Kabataan Elections (BSKE) will begin July 3.

In Resolution No. 10899, the Commission on Elections (Comelec) set the filing period from July 3 to 7.

Campaign activities are prohibited from July 8 to Oct. 18 while the campaign period will be on Oct. 19 to 28.

It will be illegal to remove or deface lawful propaganda materials; use or post illegal campaign materials; use armored land, water or air crafts; deploy police officers as bodyguards; release public funds; and construct village-funded roads and bridges during the campaign period.

During the election period from July 3 to Nov. 14, it is forbidden to bear or carry firearms; use security personnel; buy and sell votes; transfer civil service employees; and suspend local elective officials.

On the eve of election day, campaigning shall be banned as well as selling, buying, serving, and taking intoxicating liquor.

Voting will start 7 a.m. and end 3 p.m.

The counting and canvassing of votes as well as the proclamation of winning candidates shall take place immediately after the close of voting.

The Commission on Elections (COMELEC) just resumed voter registration processes nationwide and it will last until January 31, 2023, according to a news article published by the Philippine News Agency (PNA). COMELEC offices around the country are operating and waiting for voters as well as newcomers to come in.

Comelec spokesperson John Rex Laudiangco said the registration period will run until Jan. 31, 2023, in preparation for the December 2023 Barangay and Sangguniang Kabataan elections.

Qualified voters may visit Comelec office in their cities and towns from Monday through Saturday, from 8:00 am to 5:00 pm, Laudiangco said.

He noted though that there are three malls outside the National Capital Region (NCR) tapped as pilot test areas of the Register Anywhere Project (RAP) aside from the five malls located in Metro Manila that can accommodate qualified applicant residing anywhere in the Philippines. will be held on Saturdays and Sundays only between Dec. 17 to Jan. 22, 2023, except Dec. 24, 25 and 31, 2022 and Jan. 1, 2023.

“The RAP Pilot Test will be conducted at the following sites: SM Mall of Asia (Pasay City), SM Fairview (Quezon City), SM Southmall (Las Piñas City), Robinson’s Place Manila and Robinson’s Galleria (Quezon City),” the poll body official said in a statement released late Friday night.

“Additional RAP sites for those who are temporarily in the following areas but want to register and vote in their respective towns and cities outside of these areas, Robinson’s Mall Tacloban, Barangay Baras Baras, Tacloban City; SM City Legazpi, Imelda Roces Avenue, Zone 9, Barangay 37 Bitano, Legazpi City, Albay and Robinson’s Mall Naga, Naga City, Camarines Sur,” he added.

Aside from the malls, applicants can also register at the Senate of the Philippines in Pasay City on Jan. 25, 2023.

RAP will also be opened at House of Representatives in Quezon City and the Government Service Insurance System (GSIS) Main Office in Pasay City, although the schedule has not been finalized yet.

The public is advised to check Comelec announcements through Comelec’s website http://www.comelec.gov.ph and official social media pages (Facebook, Twitter, YouTube, Instagram, Tiktok).

“All types of applications will be accepted: new voter, transfer, reactivation, reinstatement, change/correction of entries, overseas to local registration regarding mall sites and its schedules,” Laudiangco added.

Applicants are advised to bring valid proofs of identifications such as National ID (PhilSys), passport, driver’s license, employment ID, student ID or library card signed by the management of the school, college or university, Senior Citizens ID, PWD ID, Indigenous Peoples Certificate from the National Commission on Indigenous Peoples, and notarized Barangay Certification with applicant’s photo and signature.

To qualify as Barangay voters, applicants should be 18 years old and above, Filipinos residing in the Philippines for at least one year, and residing in the area where he/she is looking to get registered for at least six months prior to Election Day.

If the national authorities do not approve any postponement, then the Barangay and Sangguniang Kabataan elections (BSKE) should push through on December 5, 2022 from 7AM to 3PM as set by the Commission on Elections (COMELEC), according to a Manila Bulletin news report.

The Commission on Elections (Comelec) has set the voting period during the Dec. 5, 2022 Barangay and Sangguniang Kabataan polls from 7 a.m. to 3 p.m.

In Resolution No. 10831, the Comelec said, the counting and canvassing of votes and proclamation of winning candidates shall immediately take place after the closing of polls.

Unlike in the last May 9 National and Local Elections which was automated, Comelec Acting Spokesperson John Rex Laudiangco said, the BSKE will be manual.

“The difference between NLE and BSKE is the manner. Practically, the personnel involved and equipment are just the same. The difference is the machine and ballot. This is manual,” he said in an interview last month.

The Comelec this week said that the Chairman George Garcia said that the printing of ballots and other election documents for the BSKE will start in September.
