2025 election candidates reminded by BIR of tax obligations

With the 2025 National and Local Elections over, the Bureau of Internal Revenue (BIR) reminded all candidates that they are subject to tax regulations and must prepare themselves to meet with the requirements, according to a news article by the Philippine News Agency (PNA). Failure to do so could mean tax evasion charges.

The Bureau of Internal Revenue (BIR) is reminding all candidates and political parties who ran in the 2025 elections that they are subject to tax regulations and must comply with key requirements as part of their duties as candidates for public office.

In a television interview, BIR Commissioner Romeo Lumagui Jr. emphasized that all candidates and political organizations, including party-list groups must issue BIR-registered invoices for contributions they receive, whether in cash or in kind.

“At pag nagbabayad sila sa kanilang mga suppliers ay kinakailangan nilang mag-withhold ng 5 percent dun sa kanilang suppliers (They also need to withhold 5 percent when they pay to their suppliers),” he said, as quoted in a news release on Thursday.

He added that candidates must keep track of their expenses and submit detailed reports, or Statement of Contribution and Expenditure (SOCE), not just to the Commission on Elections but also to the BIR.

“Para makita natin na lahat kung compliant ang kanilang obligasyon dito (This is for us to determine if everybody is compliant with their obligations),” he said.

Lumagui further reminded that while candidates and parties are allowed to keep excess campaign contributions, they need to pay taxes on these.

“Pagka sobra naman ang natanggap nila na mga contributions sa mga ginastos nila, kinakailangan nilang bayaran ang income tax patungkol dito sa sobrang natanggap nila (If the contributions they received are more than what they spent, they need to pay income tax on the excess funds).”

Dismissed Bamban mayor Alice Guo back in the Philippines, now under custody

Alice Guo, the dismissed mayor of Bamban who got caught by Indonesian authorities, was brought back here in the Philippines during the early hours of Friday escorted by Philippine government officials and she has been placed under the custody of the local authorities, according to a GMA Network news report.

Dismissed Bamban, Tarlac Mayor Alice Guo is back in the Philippines after being deported from Indonesia where she was arrested.

Escorted by top police and local government officials, Guo arrived from Jakarta on a private plane which landed at a private hangar at the NAIA .

Bureau of Immigration (BI) Commissioner Norman Tansingco confirmed the successful return of Guo to the Philippines.

“Guo arrived at Ninoy Aquino International Airport (NAIA) at approximately 1:30 AM on September 6 aboard a special government flight. Her return comes after a swift operation by Philippine immigration authorities in Jakarta, in coordination with their Indonesian counterparts,” according to the statement issued by bureau.

The BI said it immediately executed the mission order against Guo, Tansingco said, faces charges of undesirability and misrepresentation under Philippine immigration laws.

Interior and Local Government Secretary Benhur Abalos and Philippine National Police chief General Rommel Marbil on Thursday went to Indonesia for the turnover of custody of the former mayor from the Indonesian police.

In an earlier press briefing, PNP spokesperson Police Colonel Jean Fajardo said that Guo will undergo a medical check-up at Camp Crame upon arrival. She will be turned over to the Senate on Friday morning for the implementation of the upper chamber’s arrest warrant.

Guo was arrested by Indonesian authorities in Tangerang City, Indonesia at 1:30 a.m. on Wednesday.

The former mayor had cut her hair, which National Bureau of Investigation director Jaime Santiago believed was an attempt to conceal her identity.

Guo had asked Abalos for help over what she said were death threats against her.

In a video posted on Abalos’ Facebook of his meeting with Guo in Jakarta on Thursday afternoon, Guo was heard saying, “Sec, patulong. May death threat po kasi ako.”

Abalos entire reply was no longer heard but there was a portion in which he said, “Kaya nga kami kumuha ng private plane…”

The Department of Justice (DOJ) on Wednesday confirmed the arrest of former Bamban, Tarlac mayor Alice Guo, also known as Guo Hua Ping, in Tangerang City, Jakarta, Indonesia.

In a statement, the DOJ said Guo was apprehended at 11:58 p.m. on Sept. 3, according to Senior Superintendent Audie Latuheru of the Indonesian Police.

“This development has been verified by our counterparts in Immigration, who have confirmed that Ms. Guo is currently in the custody of the Indonesian Police at Jatanras Mabes Polri,” the DOJ said.

Justice Secretary Jesus Crispin Remulla welcomed the development, saying Guo’s arrest is a testament to the tireless efforts of law enforcement agencies and the strength of international cooperation in bringing fugitives to justice.

“We will ensure that all legal processes are followed to hold her accountable for any crimes committed. The DOJ is committed to pursuing justice and will continue to coordinate closely with Indonesian authorities to facilitate the necessary legal procedures,” he said.

Guo is facing complaints about her alleged involvement in the illegal Philippine Offshore Gaming Operators (POGOs) in the country and questions about her citizenship.

Despite being the subject of an immigration lookout bulletin due to the ongoing investigations, Guo was able to leave the country last July 18.

Guo reportedly headed to Malaysia, arrived in Singapore on July 21, and traveled to Indonesia on Aug. 18.

Guo’s sister, Shiela, and business associate Cassandra Li Ong were earlier arrested in Indonesia and already sent back to the Philippines.

During the Senate Subcommittee on Justice and Human Rights hearing, Shiela admitted she left the country with the dismissed mayor by boat.

Meanwhile, the Bureau of Immigration (BI) is expecting the return of the dismissed mayor to the country anytime soon following her arrest in Indonesia.

“We have immediately forwarded the information to the Department of Justice and the Office of the Executive Secretary. The information has been confirmed by our immigration counterparts in Indonesia, and we are very happy with this development,” BI Commissioner Norman Tansingco said in a statement.

The BI chief also believes Guo’s return to the Philippines will shed light on many questions about her illegal departure, as well as allow her to face the charges filed against her.

Meanwhile, President Ferdinand “Bongbong” Marcos, Jr., welcomed the arrest of Guo and assured the public of the resolution of cases against her.

The Bureau of Internal Revenue’s (BIR) Illicit Trade Task Force raided Sunday the Philippine Vape Festival 2024 in Las Piñas City and confiscated illicit vape products.

In a statement, BIR Commissioner Romeo Lumagui Jr. said surveillance of the event confirmed that there were vape products without internal revenue stamps.

“The illicit vape being displayed in this festival shows the brazen attitude of the vape industry against the proper taxation of vape products. They even organized a festival filled with illicit vape. The full strength of the BIR Illicit Trade Task Force will be deployed against this industry,” Lumagui said.

About 5,385 illicit vape products have been seized. The inventory of the illicit vape products confiscated during the festival is still ongoing but the BIR said the initial estimate of tax liabilities is at least PHP7 million.

Lumagui noted that while the parties to the transfer are Guo and Uy, Carreon, as the corporate secretary of Baofu, would also be charged with the same criminal case for tax evasion due to her “deliberate failure to report” the non-payment and non-filing of CGT and DST returns to the BIR.

“She even verified under oath the General Information Sheet reflecting the transfer even if no taxes were paid and no returns were filed,” he said.

BIR admits taxing social media influencers is difficult

The Bureau of Internal Revenue (BIR) continues to have difficulty in making social media influencers comply with the country’s tax laws even amid a widening adoption of various social media platforms as a form of income.

BIR Assistant Commissioner Jethro Sabariaga said the country’s largest revenue collecting agency remains in dialogue with social media influencers for them to pay their tax obligations to the government.

The BIR decided to seek a dialogue with the influencers in March this year. Sabariaga admitted that it is difficult for the BIR to get revenues from the digital space.

“Yes, (it is difficult). We will not mince with words. It might take some time, but that’s what we’ve been doing,” Sabariaga said.

“We are trying to win their side in the engagement process. The more that you can ask them to do voluntary compliance, the better rather than to fight with them,” he said.

BIR defines social media influencers as people whose digital posts are being monetized, classifying them as self-employed individuals or persons engaged in trade or business as sole proprietors.

The BIR earlier said it was looking into some 250 top earning social media influencers to see if they have been paying their obligations.

Based on BIR’s circular, influencers are required to pay income tax and percentage tax or value-added tax, if applicable, as mandated by the Tax Code.

According to the BIR, influencers derive their income from YouTube, sponsored social and blog posts, display advertising and affiliate marketing, among others.

BIR says half a trillion Pesos lost to tax evasion each year

Tax evasion remains a very serious problem in the Philippines. As far as the Bureau of Internal Revenue (BIR) is concerned, the authorities lose around half a trillion Pesos each year due to tax evasion, according to a BusinessWorld news report.

THE GOVERNMENT loses around P500 billion annually to tax evasion, according to a top Bureau of Internal Revenue (BIR) official.

“There is a lot, especially if we include those involved in illicit trade. In cigarettes alone, there’s around P100 billion,” BIR Commissioner Romeo D. Lumagui, Jr. said, when asked about revenue losses from tax evasion.

“Leakages aren’t part of that yet, like petroleum or vape products that aren’t registered, as well as fake receipts. I think it won’t go below P500 billion if you add everything up,” he added.

Mr. Lumagui said the BIR will have an easier time achieving its collection targets if it addresses tax evasion.

Earlier this month, the BIR filed 74 tax evasion complaints worth P3.5 billion against several companies.

“We will tailor efforts to improve digital services so businesses will leave the shadow economy and join the tax net. We will now focus on enforcement activities against tax evaders, put emphasis on tapping uncollected taxes through illegal activities,” Mr. Lumagui said.

The BIR is currently monitoring and investigating a number of suspected tax evaders.

“The most important right now is the selling of fake receipts and we know who (they are). We are investigating so we can file a case against those involved,” Mr. Lumagui said.

The BIR is targeting to collect P2.6 trillion in revenues this year.

“With all our activities and efforts we are making, we will be able to achieve the tax collection target,” he said.

In 2022, the agency collected a total of P2.34 trillion, surpassing its P2.1-trillion target.

Meanwhile, Mr. Lumagui said the agency will also review its policies after the Supreme Court declared void its regulations that require firms to disclose the personal information of investors.

“We must respect the privacy (of these investors) but when it comes to the correct amount of taxes, the BIR has auditing power. There is still a need to pay taxes and the compliance of these businesses needs to be monitored. When it comes to determining the correct amount of taxes, we can investigate that,” he added.

The Supreme Court declared that the BIR Revenue Regulations No. 1-2014 and Revenue Memorandum Circular (RMC) No. 5-2014 “void for being unconstitutional” as it violated the right to privacy.

The regulations require businesses to disclose investor information such as addresses, tax identification number (TIN), and birthdays, among others.
