The bid of the controversial and suspended Bamban mayor Alice Guo to lift the preventive suspension has officially been rejected by the Office of the Ombudsman, according to a GMA Network news report.

The Office of the Ombudsman has junked Bamban, Tarlac mayor Alice Guo’s bid to lift the six-month preventive suspension slapped against her over her alleged links to a raided Philippine Offshore Gaming Operator (POGO) in her jurisdiction.

The Ombudsman resolution dated June 21 said it is standing by its preliminary findings that there are sufficient grounds to hold that the evidence against Guo and the other respondents are strong.

Aside from Guo, also suspended by the Ombudsman were Bamban Business Permit and Licensing Office (BPLO) officer Edwin Campo and Municipal Legal Officer Adden Sigua.

The Ombudsman suspended the three in May to keep them from interfering in the investigation following the complaint filed by the Department of the Interior and Local Government (DILG), which is accusing them of committing grave misconduct, serious dishonesty, gross neglect of duty, and conduct prejudicial to the best interest of the service.

In its resolution signed by Ombudsman Samuel R. Martires, there is evidence that Guo has business interest in Baofu Land Development Inc., owner of the land where the raided POGO was located. It said this was shown by a Tarlac Electric Cooperative Inc Statement of Account dated March 8, 2024 under Guo’s name that was seized during the March 13, 2024 raid in the Baofu compound for alleged human trafficking and serious illegal detention.

The Ombudsman also cited documents showing that Baofu and the POGO, Zun Yuan, operated their respective businesses with permits processed by the BPLO and issued by Guo, as well as documents showing that Sigua knew and had prior acquaintances with Guo since he was the one who notarized each of the Deed of Absolute Sale covering the eight parcels of land that Guo bought that later on became the compound.

“This Office only deems it prudent to preventively suspend respondents Guo, Campo and Sigua given their undeniable hand in the operation of Baofu and Zun Yuan,” the Ombudsman said.

“After due consideration of the factual circumstances of the instant case, this Office finds no compelling reason to reconsider and lift the Order of preventive suspension of respondents Guo, Campo and Sigua while the case against them is pending adjudication,” it added.

Suspended Bamban mayor Alice Guo and others charged for alleged human trafficking

The controversial and suspended Bamban mayor Alice Guo along with others were formally charged before the Department of Justice (DOJ) for alleged human trafficking in connection with the raided Philippine Offshore Gaming Operator (POGO) hub in Tarlac, according to a GMA Network news report.

In complaints filed before the Department of Justice (DOJ), Guo, former Technology and Livelihood Resource Center (TLRC) deputy director general Dennis Cunanan, and 12 officers and incorporators were charged with violation of Sections 4 and 6 of Republic Act (RA) 9208 or the Anti-Trafficking in Persons Act of 2003 as amended by RA 10364, as further amended by RA 11862.

Among the respondents are Guo’s alleged business partner Huang Zhiyang, who is a fugitive in China, and Zhang Ruijin and Baoying Li, two individuals who are involved in the biggest money laundering case in Singapore.

Guo was also referred to as “a.k.a Guo Hua Ping” in the complaint.

GMA News Online has sought comment from the camps of Guo and Cunanan but they have yet to reply as of posting time.

Evidence – The complainants are the Presidential Anti-Organized Crime Commission (PAOCC) and the Philippine National Police-Criminal Investigation and Detection Group (PNP-CIDG).

“Lumabas na mga ebidensya dito tulad ng fact na siya ang nag apply doon sa dating [letter of no objection] from the local government. Lumabas din ang kanyang involvement doon sa lesser company,” Inter-Agency Council Against Trafficking chairperson and Justice Undersecretary Nicky Ty said in a briefing.

(There is evidence such as the fact that she applied the letter of no objection from the local government. Her involvement in the lesser company was also noted.)

“At kasama rin yung ibang ebidensya diyan katulad nung pangalan niya na lumulutang sa mga sabi-sabing document na nahanap sa POGO compound,” he added.

(There is also other evidence such as her name appearing in many documents in the POGO compound.)

Meanwhile, Prosecutor Benjamin Samson said authorities believe that Cunanan is part of a “grand conspiracy.”

“We discovered that the Zun Yuan operation actually started with one corporation which was Baofu, and then another corporation was created. All these three corporations, we believe that they are part of a grand conspiracy to commit labor trafficking,” Samson said.

“In one of the corporations, we found a document wherein the name of Mr. Dennis Cunanan appeared. After piecing together the pieces of evidence, we concluded and we decided that he is part of the grand conspiracy to commit labor trafficking,” he added.

Earlier, Senator Risa Hontiveros showed documents where Cunanan had introduced himself as the “authorized representative” for the Hong Sheng POGO in Bamban and the Lucky South POGO in Porac.

Other Complaints – According to Ty, the DOJ is now processing the Immigration Lookout Bulletin against Guo, which may be issued next week.

“Hindi naman natin matatanggi na kahit sinong makasuhan ng kriminal ay may flight risk, lalo na kung may resources ito mangibang bansa. Ngunit ito naman kay Mayor Guo, hopefully, no hindi naman siya lilipad dahil siya mismo at ang kanyang mga representatives ang nag sabi na nais niyang harapin ang mga alegasyon laban sa kanya,” he said.

(Anyone charged with a crime is a flight risk, especially if he they have resources to go abroad. Hopefully, she will not leave as her representatives said that he wants to face the allegations against him.)

Aside from this, Ty said Guo cannot travel without a travel authority as a public official.

Ty said that “there is a possibility” that other complaints may be filed against Guo and others.

POGO – Guo was placed under investigation for her alleged links to the 10-hectare POGO compound that was raided in March for alleged illegal activities that include crypto and love scams.

Earlier in June, the Department of the Interior and Local Government filed graft charges against Guo with the Office of the Ombudsman, prompting it to suspend her for up to six months.

Guo’s identity as a Filipino is also under question before the Senate.

Senator Sherwin Gatchalian has questioned whether Chinese passport holder Guo Hua Ping is Guo after he presented records from the Board of Investments of the Guo family’s application for a Special Investors Resident Visa.

The documents showed Guo Hua Ping entered the Philippines on January 12, 2003 when she was still 13 years old and her registered mother is Lin Wenyi, the same woman who was alleged to be the mayor’s mother.

Residents of the City of Las Piñas will be voting in a plebiscite – to be conducted by the Commission on Elections (COMELEC) – to approve or reject an ordinance that will set the territorial boundaries of all barangays on June 29, 2024, according to a Manila Bulletin news report. Voting hours will be from 7AM to 3PM.

The Commission on Elections (Comelec) will conduct a plebiscite to allow Las Piñas City residents to vote for or against an ordinance that sets the territorial boundaries of the 20 barangays in the city on June 29.

City Ordinance No. 1941-23 Series of 2023 delineates the territorial boundaries of the 20 barangays in the city in accordance with the Department of Environment and Natural Resources’ (DENR) cadastral survey that was completed in March 2015.

The ordinance states that since the creation of the barangays in 1978, “the territorial metes and bounds of the said barangays have not been properly identified such that there are barangays whose land areas are not contiguous and/or overlapping with another barangay.”

“Moreover, confusion in the territorial boundaries of the barangays is being encountered which could cause disputes, or be subject of disputes, especially since the cadastral mapping in 1980 for the barangays conflicted with the boundaries as set forth in the Presidential Decrees,” the ordinance states.

The local government offices in Las Piñas and several national government agencies such the Department of the Interior and Local Government, Department of Budget and Management, Philippine Statistics Authority, and the Comelec will be given three years from the ordinance’s ratification to make appropriate changes in their respective records to conform with the new boundaries and jurisdictions of the barangays.

Now that the P17.99 billion contract with new provider Miru Systems has been signed, the Commission on Elections (COMELEC) announced that it aims to ensure the integrity of the 2025 National and Local Elections and they will not hesitate to apply the full extent of the law against those who intend to commit irregularities and poll sabotage, according to a Philippine News Agency (PNA) news article.

The Commission on Elections (Comelec) on Monday warned it would not hesitate to apply the full extent of the law to those who are out to jeopardize the country’s electoral process.

Comelec chairperson George Erwin Garcia issued the warning during the signing of the contract for the Full Automation System with Transparency Audit/Count (FASTrAC) project with officials of South Korean firm Miru Systems Inc., headed by president Jinbok Chung, its service provider for the next polls.

Garcia said electoral sabotage is a non-bailable offense and can be meted with a penalty of life imprisonment under Republic Act 9369 or the Election Automation Law of 2007.

He also warned Miru and its Filipino partners against politicians and political parties who might approach them to rig the polls.

“Inemphasize ko sa kanila, kung kaya nyo gawin yan, huwag na huwag nyo gawin yan under the present leadership of this Commission. We want ang pinaka maayos na elections, credible, pinaka pinagkakatiwalaan election ng 2025. Sabi ko kung gusto nyo pa mag participate sa mga susunod na procurement ng Comelec, ayusin nyo 2025 elections (I emphasized to them ‘if you can do that, never do that under the present leadership of the commission. We want the 2025 elections to be most organized, credible and reliable. I told them, ‘if your want to participate in future procurements of the Comelec, make sure that the 2025 elections would be smooth),” he added on the sidelines of the signing rites.

The poll body chief also said Miru must prove to Filipinos that it deserves to bag the poll automation deal by establishing a highly credible and transparent system.

At the same time, Garcia acknowledged the support of the South Korean government for the poll automation project.

“We are pleased with the presence of the South Korean ambassador (Lee Sang-hwa) because it proves that he is supportive of this endeavor and we can trust the company that we have as partners simply because the government of Korea is very supportive of this endeavor,” he said.

Hackers – Garcia, meanwhile, said they are coordinating with law enforcement authorities against hackers who might manipulate the polls.

“Sumulat na kami sa National Bureau of Investigation asking for assistance para maaresto or mapigilan mga taong ito. So siguro napreempt na kanilang plano (We have sent a request to the NBI asking them to arrest or prevent these people from carrying out their illegal acts. I think their plans were preempted),” he said.

The poll body is looking to start the customization of the automated counting machines (ACMs) next month. Garcia said this customization process usually takes six months.

“If we can have it shortened, it would be better. But in our experience, it’s really six months. If we start by April, six months from April. We have two months for international certification and one month for source code review,” he added.

Meanwhile, Chung vowed they would comply with the rules set by the Philippine government.

“Our goal is also to build up our company and to expand and we’re looking towards the future. We will not do anything that will jeopardize our future and also the election process of the Philippines. We promise, we can guarantee that we will be transparent all throughout the process. We will abide by the rules of the Comelec, of this nation,” Chung said in Korean and was translated to English by Miru overseas sales representative Jason Lee.

Under the contract, the joint venture (JV) of Miru Systems Co Ltd, Integrated Computer Systems, St. Timothy Construction Corporation, and Centerpoint Solutions Technologies, Inc. (MIRU-ICS-STCC-CPSTI) will provide 110,000 ACMs, ballot boxes; laptop and printer; and ballots.

Motorists who travel around the Metro Manila regularly should be aware that the Supreme Court recently officially invalidated local government units (LGUs) of the National Capital Region (NCR) from issuing traffic violation tickets and seizing drivers’ licenses and ordered them to follow the ticketing system of the Metropolitan Manila Development Authority (MMDA), according to a Philippine News Agency (PNA) news article.

The Supreme Court (SC) has invalidated provisions of ordinances by local government units (LGUs) in Metro Manila allowing their respective traffic enforcers to issue violation receipts and confiscate driver’s licenses.

“A permanent injunction is hereby issued to enjoin respondent local government units from further issuing ordinance violation receipts; and confiscating licenses through their own traffic enforcers, unless they are deputized by the Metro Manila Development Authority (MMDA),” the court said in its 42-page decision uploaded March 4 and penned by Associate Justice Alfredo Benjamin Caguioa.

This stemmed from a suit filed by 11 transport groups before the Court of Appeals in 2006, claiming that different citations from the MMDA and the LGUs are confusing as some bodies do not recognize tickets by other LGUs or the MMDA.

While the case was pending in 2012, a resolution by the MMDA Metro Manila Council (MMC) then adopted a uniform ticketing system and established a system of interconnectivity among the LGUs involved in transport and traffic management in Metro Manila.

In December of that year, the appellate court dismissed the suit, prompting the petitioners to elevate the case to the high tribunal.

The tribunal, in its ruling, said traffic management in the LGUs is covered by the MMDA Law.

“(T)he Court thus declares as invalid the common provision in the said traffic codes or ordinances of the LGUs in Metro Manila empowering each of them to issue OVR (ordinance violation receipts) to erring drivers and motorists,” the SC said.

Department of Trade and Industry (DTI) Secretary Alfredo Pascual reaffirmed the department’s commitment to boost its science, technology and innovation-driven industrialization agenda with the enactment of Republic Act (RA) 11982 or the Tatak Pinoy Act on Monday.

In line with President Ferdinand R. Marcos Jr.’s priorities in the Philippine Development Plan (PDP) 2023-2028, the newly passed legislation will empower Philippine industries to manufacture a broader range of higher quality and sophisticated products, elevate the country’s position in the global value chain, and enhance productivity and competitiveness in the global market.

The Tatak Pinoy Law lies at the core of the nation’s industrialization strategy, revitalizing and driving the economic agenda with precision. With its focus on promoting industrial excellence, embracing innovation and navigating contemporary challenges, Tatak Pinoy is a transformative legislation that empowers Philippine industries to thrive in an intensely competitive global landscape.

“We are confident that this legislation will bolster our ongoing programs, propelling industries towards greater global recognition and success. The Atlas of Economic Complexity, which measures the level of sophistication of export products being produced by countries globally, ranks the Philippines as 33rd among 133 countries, with an overall economic complexity index of 0.76.

This is driven by the country’s exports of high to moderate complex products such as electronics and integrated circuits, electrical machinery and equipment, as well as information and communications technology (ICT) services.

The country ranks 4th in Southeast Asia, trailing behind Singapore (5th), Thailand (23rd), and Malaysia (28th), and above Vietnam (61st) and Indonesia (64th).

“The Tatak Pinoy Law is a significant milestone that will enable our industries to climb up the economic complexity ladder, making the Philippines a more formidable player in the global market. Tatak Pinoy will enable our industries to embrace new technologies and effectively overcome the challenges of the modern world,” DTI Undersecretary Rafaelita Aldaba said.

With the implementation of the Tatak Pinoy Law, the DTI aims to elevate the country’s ranking by supporting and promoting the production of more sophisticated and high-quality products.

Tatak Pinoy will build on the existing flagship initiatives of the DTI, such as the One Town, One Product (OTOP) and Malikhaing Pinoy Program, which cultivate and promote unique products and empower local entrepreneurs and innovators to elevate the quality and marketability of locally made products.

Tatak Pinoy is poised to revolutionize industries, particularly Philippine manufacturing, amidst the entry of Fourth Industrial Revolution technologies. It will amplify DTI’s efforts in building an Industry 4.0 Pilot Factory, establishing a Center for Artificial Intelligence Research (CAIR), and supporting the country’s Regional Inclusive Innovation Centers (RIICs).

The new law will also drive innovation and facilitate Industry 4.0 adoption, especially among micro, small and medium-sized enterprises (MSMEs).

President Ferdinand R. Marcos Jr. on Monday signed into law Republic Act (RA) 11981, or the Tatak Pinoy (Proudly Filipino) Act, and RA 11982, granting benefits to octogenarians and nonagenarians.

“Today, it’s my honor to sign into law two bills which not only honor two key sectors of society, but mandate measures that protect their rights and promote their development,” Marcos said in his speech during the signing of the two bills at Malacañan Palace’s Ceremonial Hall.

“Each of these laws encapsulates the merits that the Bagong Pilipinas uphold toward building a strong nation. For example, the Tatak Pinoy Act is about investing in Filipino competence and talent. “It is about creating products and services of the highest quality, because Tatak Pinoy is also about excellence, and as a seal of great workmanship, it must only be applied to those that meet this high standard. As such, we shall give preference and priority to our products,” he said.

RA 11982 or the Amendments to the Centenarians Act of 2016, meanwhile grants monetary benefits to octogenarians and nonagenarians.

Through the expanded Centenarian Act, senior citizens aged 80, 85, 90 and 95, whether residing in the Philippines or abroad, will receive PHP10,000 cash incentive every age milestone and will still receive PHP100,000 upon reaching 100 years old.

Marcos said the expansion of the coverage of the Centenarians Act is a homage to the Filipino trait of compassion, and in the Philippine culture, this shows more kindness and compassion to the elderly.

“But they deserve more than cash in an envelope. What they should get is a support infrastructure that every society owes to its greying population. There were already close to 10 million seniors two years ago … But as this demographic enlarges, the societal facilities that attend to them should be expanded as well,” Marcos said.

Honoring the elderly – Senators believe that the Expanded Centenarians Act shall have a huge impact on the lives of elderly Filipinos.

“Malaking bagay iyon para sa kanila lalo na’t may mga pangangailangan din sila at gastos para sa gamot, vitamins, supplement, pagkain at iba pa (It is a big thing for them especially for their expenses in medicine, vitamins, supplement, food, among others),” Senator Ramon Revilla Jr., who authored the law, said in a statement.

Revilla explained the new law intends to provide cash benefits for Filipino octogenarians and nonagenarians “so that they would get to enjoy it more.”

He recalled filing the measure during the start of the 18th Congress in 2019 but failed to be passed into law.

The lawmaker assured that he will continue to push for the expansion of the 20 percent discount of senior citizens and exemption from value-added tax to include supplements, vitamins, herbal products, formulated milk, among others.

Revilla said he is also proposing to bring the age down to 56 years old to be considered as a senior citizen.

Recently in the progressive City of Muntinlupa, the City Government formally told all telecommunication companies and service providers to relocate the overhead cables and wires underground this year in accordance to an existing city ordinance, according to a Manila Bulletin news report.

All telecommunication companies and service providers that use overhead wires and cables are required to relocate and install their facilities underground starting this year in Muntinlupa.

This is mandated by Muntinlupa City Ordinance 2021-256 which was passed by the Muntinlupa City Council in August 2021.

2021-056 is an “ordinance requiring/mandating all telecommunication companies, service providers, and other similar entities that use overhead wires and/or cables operating within the City of Muntinlupa to install and/or relocate wire and cable system underground.”

Muntinlupa Councilor Mamerto Sevilla Jr., chairman of the Committee on Land Use and Zoning and one of the sponsors of the ordinance, told Manila Bulletin that the ordinance will take effect by August this year.

“Yung ordinance kasi ipinasa noong 2021, August. Implied doon sa ordinance na after three years magte-take effect. So yung three years niya this August (The ordinance was passed in 2021. It is implied in the ordinance that it will take effect after three years. So the three years will be this August),” said Sevilla.

He said by August this year, affected companies under the first phase should have relocated their wires and cables underground.

The implementing rules and regulations (IRR) are being prepared by the Muntinlupa City government.

The ordinance stated that “it is necessary to protect the residents from the hazardous effects of overhead lines in the event of earthquakes, heavy rain or thunderstorms.”

“An underground cabling system will serve the purpose of having a sustainable, safe, and clean aesthetic view of power lines to respond to the changing needs of technology which are likewise less susceptive to mechanical damages,” it added.

The ordinance covers “all telecommunication companies, service providers, and other similar entities which use overhead wires and cables located within the territorial jurisdiction of the City of Muntinlupa.”

The Manila Electric Company (Meralco) will be allowed to maintain its overhead wiring and cabling subject to restrictions.

Under the Muntinlupa ordinance, telecommunication companies and service providers are defined as “any company, private corporation or business entity which has a franchise to operate a system of transmission of signs, signals, messages, words, writings, images and sounds or information of any nature by wire, radio, optical electromagnetic systems.”

In recent times, Philippine President Ferdinand “Bongbong” Marcos, Jr., signed into law the Ease of Paying Taxes Act (officially referred to as Republic Act Number 11976 or RA11976), according to a news article by the Philippine News Agency (PNA).

President Ferdinand R. Marcos Jr. signed into law Republic Act (RA) 11976 or the Ease of Paying Taxes Act which aims to modernize and increase the efficiency and effectiveness of tax administration and strengthen taxpayer rights.

In a statement on Sunday, the Presidential Communications Office (PCO) said the Ease of Paying Taxes Act is one of the priority legislations mentioned during the State of the Nation Address in 2022 and 2023.

“The law allows the government to capture as many taxpayers as possible into the tax net by streamlining the system and minimizing the burden on taxpayers, increasing the country’s revenue collection in the long run,” the PCO said.

The new law, signed on Friday, introduces administrative tax reforms and amendments to several sections of the National Internal Revenue Code of 1997.

It also updates the Philippine taxation system, adopts best practices and replaces antiquated procedures.

Among RA 11976’s salient features are classification of taxpayers into micro, small, medium, and large; electronic or manual filing of returns and payment taxes either to the Bureau of Internal Revenue (BIR), through any authorized agent bank or authorized tax software provider; option to pay internal revenue taxes removal to the City or Municipal Treasurer; elimination of the distinction between documentation and basis of sales of goods and services; and classification of value-added tax (VAT) refund claims into low, medium and high-risk.

The law ensures the availability of registration facilities to non-Philippine resident taxpayers; promoting and assisting taxpayers in tax processes; streamlining; reducing documentary requirements; and digitalizing BIR services through the development of the Ease of Paying Taxes and Digitalization Roadmap.

The law likewise imposes 180 days to act on claims for refund of erroneous or illegal tax collection and increases the amount for the mandatory issuance of receipts for each sale and transfer of goods and services from PHP100 to PHP500.

According to PCO, the law mandates the BIR to adopt an integrated digitalization strategy by providing end-to-end solutions for the benefit of taxpayers.

These include adopting integrated and automated system for facilitating basic tax services, setting up electronic and online system for data and information exchange between offices and departments, streamlining of procedures by adopting automation and digitalization of BIR services, and building up BIR’s technology capabilities.

RA 11976’s implementing rules and regulations shall be promulgated 90 days from the effectivity of the Act after the consultation of the Finance Secretary with the BIR and the private sector.

Human trafficking is a very serious crime here in the Philippines and this was strongly reflected in the decision of a regional trial court (RTC) in Las Piñas City when it convicted a Chinese national and sentenced him to twenty years imprisonment along with a fine of P1 million, according to a Philippine Star news report. The said suspect was reportedly the operator of a Philippine Offshore Gaming Operator (POGO) located in Las Piñas City which got raided.

A Las Piñas court has convicted a Chinese man, reported to be a Philippine offshore gaming operator (POGO), for human trafficking.

In a decision dated Oct. 27, Judge Phoeve Meer of Regional Trial Court Branch 275 found Andy Chen guilty of violating Republic Act 9208 as amended by RA 10364 or the Expanded Anti-Trafficking in Persons Act.

Meer sentenced Chen to 20 years imprisonment and slapped him with a fine of P1 million.

The court also ordered Chen to pay his victim, a Chinese woman, P400,000 in moral and exemplary damages.

The victim, a POGO worker, was rescued by operatives of the Women and Children Protection Center (WCPC) during a raid on XinChuang Network Technology on Alabang-Zapote Road in Barangay Almanza Uno on Dec. 1, 2021.

WCPC director Brig. Gen. Portia Manalad assured the public that perpetrators of human trafficking will face the full force of the police.

In June, 2,724 people, many of them foreigners, were rescued from XinChuang’s compound during a police raid.
