COMELEC issues warning against premature campaigning before the campaign period of BSKE

The Barangay and Sanggunian Kabataan Elections (BSKE) will take place across the Philippines on October 30, 2023. Before the said election happens, the campaign period for BSKE will take place from October 19 to 28. That being said, the Commission on Elections (COMELEC) issued a warning about premature campaigning before the campaign period happens, according to a Manila Standard news report.

The Commission on Elections (Comelec) warns barangay and Sangguniang Kabataan candidates from engaging in premature campaigning before the official campaign period set October 19-28 under pain of disqualification or imprisonment.

At the same time, the Comelec said the honoraria for poll workers in the upcoming barangay and Sangguniang Kabataan elections (BSKE) has been increased up to P10,000. Comelec chairman George Garcia issued the warning saying appropriate charges will be filed against the candidates who would launch an early campaign following their filing of certificate of candidacy (COC).

Garcia reminded the candidates that the filing of COCs for the 2023 BSKE will be from August 28 to September 2, while the campaign period will run only from October 19 to October 28.

Garcia said August 28 is the start of the election period, as well as the start of the gun ban, public works ban and social services prohibition “unless explicitly exempted by the Comelec.

“Once you file your COC, you are already considered as a candidate. Therefore, we will apply the full force of the law, Section 18 of the Omnibus Election Code (OEC). You cannot go around, campaign, distribute things since you are already a candidate,” Garcia said.

Aspirants must be at least 18 years of age for barangay positions and at least 18 but strictly not more than 24 years old by the day of the election for SK posts.

The Comelec chief also urged voters to report any BSKE candidates who begin campaigning prior to the start of the official campaign period on 19 October.

In relation with their campaign against the buying and selling of votes, the Commission on Elections (COMELEC) announced that it seeks to impose a ban on money (“money ban”), according to a news article by the Philippine News Agency (PNA). This is related with the upcoming Barangay and Sangguniang Kabataan Elections (BSKE) which is scheduled to happen on late October. The election body previously announced its plan to allow warrantless arrests in response to vote buying and selling.

The Commission on Elections (Comelec) is eyeing to impose a “money ban” to combat vote buying and selling during the Barangay and Sangguniang Kabataan Elections (BSKE) on Oct. 30.

In an interview Tuesday, Comelec Chairperson George Erwin Garcia said under Section 27 of the draft of Kontra Bigay resolution, the poll body may presume vote buying or selling through one’s “possession or transport” of cash exceeding PHP500,000 five days before the election day.

“Hindi natin pipigilan ang pagwi-withdraw ng mahigit PHP500,000. Ang atin pong ipo-prohibit at ipa-punish ay yung pagpapadala ng PHP500,000 lalo na kapag pumasok yung period ng kampanya (We will not prohibit withdrawal of PHP500,000. What we will prohibit and punish are those sending PHP500,000 especially when the campaign period starts),” he said.

However, Garcia said individuals with justifiable backgrounds shall be exempted, including businessmen and disbursement officers or cashiers, among others.

“Saan ka naman nakakita may dala kang kalahating milyon isang araw bago mag election tapos ni hindi ka treasurer, ni hindi ka negosyante? Ano ka, tagapamili ng boto? So ipe-presume namin yung mga taong yan involved sa vote buying (Where can you see someone carrying half a million [pesos] before the election day and you’re not a treasurer nor a businessman? What [kind of worker] are you, a vote buyer? So, we will presume that person is involved in vote buying),” he said.

All police authorities are tasked to conduct 24-hour money ban checkpoints nationwide.

Garcia said although these measures are not under the law, setting such is also not prohibited.

Garcia said the Comelec has submitted the draft of Kontra Bigay resolution to en banc for approval of the proposed money ban and other measures, and setting of guidelines.

Besides transporting or delivering large sums of money, Comelec also aims to monitor the splitting of at least PHP20,000 cash into smaller denominations of PHP100s, PHP50s or PHP20s.

It also targets to cooperate with mobile banking and digital payment platforms to ensure they are not used for vote buying or selling.

“Ang GCash, PayMaya at iba pa pong platform ay under ng BSP (Bangko Sentral ng Pilipinas). Kausap natin ang BSP at pati na ang AMLC (Anti-Money Laundering Council) (The Gcash, PayMaya and other platforms are under BSP. We are coordinating with the BSP and AMLC),” Garcia said.

Under the Comelec draft resolution, long queues of registered voters for distribution of cash or other favors shall also be subject to the action of law enforcement.

The Commision on Elections (Comelec) on Tuesday said it is planning to allow warrantless arrest for those who will be caught in the act of buying or selling votes during the campaign period.

In a press conference, Comelec chairperson George Garcia said the commission will issue new guidelines for the barangay and Sangguniang Kabataan elections (BSKE), which is set on October 30.

“Sa ilalabas naming guidelines bilang pahapyaw lang po, papayagan natin silang mag-aresto especially kung yung tao ay caught in flagrante or caught in the act. Dati wala po yun. But under the 1987 Constitution, Garcia said warrantless arrest is allowed in cases of flagrante delicto or being caught in the act.

He pointed out that if there is a contradiction between existing law and the Constitution, the Constitution will be followed.

COMELEC declares no delays related to October 2023 Barangay and SK Elections (BSKE)

As far as the Commission on Elections (COMELEC) is concerned, there will be no delays related to the anticipated Barangay and Sangguniang Kabataan Elections (BSKE) set for October 30, 2023 and the related final list of voters will be released this August, according to a Philippine News Agency (PNA).

There will be no delays in the release of the final list of voters in August and the holding of the Barangay and Sangguniang Kabataan Elections (BSKE) by October, the Commission on Elections (Comelec) on Thursday assured.

During the Laging Handa public briefing, Comelec chairperson George Erwin Garcia said the poll body targets to provide a clean list of registered voters by the first week of August.

“Tuloy na tuloy na po iyan… ginagarantiya natin na maayos at malinis na po iyan. Kahit po iyong mga sinasabing namatay na, iyan po ay pinapatanggal din natin sa ating election registration board (It [will certainly] be pushed through… We are guaranteeing an organized and clean [list]. Even those who have already died, we are also asking the election registration board to remove them),” he said.

Any political party or citizen’s arm may secure access to the clean list from local Comelec offices once finalized.

Based on Comelec’s automated fingerprint and identification system, around 21,000 double and multiple registrants were found.

The poll body also assured the BSKE on Oct. 30 will also push through following the recent ruling of the Supreme Court on the unconstitutionality of the postponement of the December 2022 BSKE.

“Bagama’t unconstitutional nga po ang sabi ng ating Korte Suprema doon sa batas na ipagpaliban ang halalan, wala po itong epekto sa atin pong ginagawang paghahanda para sa October 30. Tuloy na tuloy po ang ating October 30 Barangay and SK Elections (Although it’s unconstitutional to postpone the elections as per the law cited by the Supreme Court, it has no effect on our preparation for October 30. The October 30 BSKE will push through),” Garcia added.

However, around 1.3 million ballots are still left for printing, particularly for those registered from Dec. 12, 2022 up to Jan. 31 this year.

Garcia said the printing of ballots for the said batch will be launched in July once the clearing of double and multiple registrants is finalized. To date, the Comelec has already printed 91 million ballots needed for the upcoming BSKE.

The Philippine National Police (PNP) warned on Monday, May 29, those who aspire to run for barangay and Sangguniang Kabataan (SK) elections to refrain from engaging with communist rebels, particularly in seeking assistance to ensure victory.

PNP chief Gen. Benjamin Acorda, Jr. said there are laws that could be used against those who would be found to be dealing with the local forces of the Communist Party of the Philippines-New People’s Army (CPP-NPA) such as the Republic Act No. 11479 or the Anti-Terrorism Act of 2020.

Acorda is particularly referring to the direct payment by candidates to the CPP-NPA, through the permit to campaign and permit to win for the barangay and SK elections scheduled in October this year.

“Let me caution candidates who will fall for this election racket of the CPP-NPA that any form of monetary or material support to the CPP-NPA, a terrorist organization, is tantamount to ‘terrorist financing’ that is punishable under Republic Act No. 11479 or the Anti-Terrorism Act of 2020,” said Acorda.

“And if the donor or giver is an incumbent Barangay or SK official, the crime is further aggravated by willful disloyalty to their Oath of Office,” he added.

The Chief PNP, however, said they do not foresee serious security problem for the barangay and SK elections.

The elections for sets of officials for the 42,022 barangay across the country will start with the 90-day election period on Aug. 28 until Nov. 29.

“This early, we do not foresee any serious peace and order concerns on a national scale in the barangay and SK elections. The actions of some remaining active guerilla fronts of the CPP-NPA are closely being monitored for possible conduct of atrocities,” said Acorda.

“Security measures are now being prepared regarding this,” he added.

The filing of certificates of candidacy for the barangay and Sangguniang Kabataan elections has been rescheduled from July to August, Commission on Elections chairman George Garcia has announced.

In an online forum, Garcia said the filing for the BSKE elections had been moved from July 3 to 7 to August 28 to September 2.

“We approved just this morning, during our en banc session, the change of the date of the filing of the COC,” said Garcia during a webinar of the UP Alumni Association and the Vinzons Policy Center (VPC) on enhancing the country’s readiness for clean and honest future elections.

“This is to ensure the AFP (Armed Forces of the Philippines) and the PNP (Philippine National Police) will be most prepared, especially because of the violence we have right now dito sa ating mga local officials,” he added.

The development came a day after Senator Francis Tolentino said he asked the poll body to delay the COC filing as conducting it in July would only “burden the local government units (LGUs)” due to election-related restrictions under the Omnibus Election Code.

Tolentino said it was “only just and fair” to adjust the filing period given the BSKE would be held during the last week of October 2023 and that the law prescribed a 10-day campaign period.

Unlike the national elections, Garcia said those who file their COCs during the prescribed period would be considered candidates and are subject to the Omnibus Election Code.

“Dito sa BSKE, we saw an opportunity. We told them ‘let them go to the courts’ because we will consider them, upon the filing of their candidacies, already as candidates. Therefore, they will be liable under Section 18 of the Omnibus Election Code for premature campaigning….We will disqualify them, we will file election offenses against these candidates,” he added.

Tolentino lauded the rescheduling of the filing period, saying it would help the LGU perform well and would ease election-related violence since “it will lessen early politicking.”

“The poll body’s decision will allow our local government units to perform their respective functions without any compromise or restrictions—construction ban, etc.,” he said.

COMELEC to intensify information drive regarding Register Anywhere Project (RAP)

As the voter registration processes are happening nationwide, the Commission on Elections (COMELEC) announced that it will intensify the information campaign to make the public more aware about their newly launched Register Anywhere Project (RAP), according to a Philippine News Agency (PNA) news article. Here in South Metro Manila, there is a RAP processing spot at SM Southmall in Las Piñas City and the turnout started really low.

The Commission on Elections (Comelec) on Monday admitted the need to intensify its information campaign regarding the holding of the Register Anywhere Project (RAP) to encourage the public to enlist themselves in several participating malls in key areas across the country.

“We still need to intensify the information drive on the RAP,” Comelec Chairperson George Erwin Garcia said in a message to reporters.

This came following a low turnout of registrants in RAP hubs in Metro Manila, Tacloban City in Leyte province and Legazpi City in Albay over the weekend.

Data released by the poll body showed a total of 611 applicants were able to register in RAP booths inside shopping establishments.

SM Fairview recorded the highest number with 190 registrants, followed by Robinsons Galleria with 133, both in Quezon City; Robinsons Place Manila with 118, and SM Mall of Asia in Pasay City with 75.

On the other hand, few registrants were recorded in other venues such as Robinsons Place Naga with 38, SM Southmall in Las Pinas with 27, SM City Legazpi with 20, and Robinsons Place Tacloban with 10.

The pilot test will be held every Saturdays and Sundays between Dec. 17, 2022 and Jan. 22, 2023, except on Dec, 24, 25, and 31, 2022, and Jan. 1, 2023.

Under the project, qualified applicants residing anywhere in the Philippines may register at the RAP booths by submitting their application form, documentary requirements, and have their biometrics taken on-site.

Barangay and Sangguniang Kabataan elections moved to October 2023

It is official! In case you missed out on the news, the next Barangay and Sangguniang Kabataan (SK) elections will take place not this year but on October 2023 as President Ferdinand “Bongbong” Marcos, Jr., signed the law of election postponement, the Philippine News Agency (PNA) reported. The Barangay and SK polls were originally scheduled to take place this December.

President Ferdinand “Bongbong” Marcos Jr. has signed a law postponing the December 2022 Barangay and Sangguniang Kabataan (SK) elections.

Republic Act (RA) No. 11935, signed by Marcos on Oct. 10, postpones the Barangay and SK elections on Dec. 5 this year to the last Monday of October 2023.

“There shall be synchronized Barangay and Sangguniang Kabataan elections, which shall be held on the last Monday of October 2023 and every three years thereafter,” the law reads.

Under RA 11935, the term of office of the Barangay and SK officials will commence at noon of Nov. 30 following their election.

“Until their successors shall have been duly elected and qualified, all incumbent Barangay and Sangguniang Kabataan officials shall remain in office, unless sooner removed or suspended,” it added.

Barangay and SK officials who are ex officio members of the Sangguniang Bayan, Sangguniang Panlungsod, or Sangguniang Panlalawigan will continue to serve as such members in the Sanggunian concerned until the next Barangay and SK elections unless removed.

The amount necessary for the implementation of RA 11935 will be taken from the appropriations of the Commission on Elections under the General Appropriations Act and/or supplementary appropriations.

“If any portion or provision of this Act is declared unconstitutional, the remainder of this Act or any provisions not affected thereby shall remain in force and effect,” RA 11935 reads.

All other laws, acts, presidential decrees, executive orders, issuances, presidential proclamations, rules and regulations which are contrary to and inconsistent with any provision of RA (11935) are repealed, amended, or modified accordingly.

RA 11935 is a consolidation of House Bill No. 4673 and Senate Bill No. 1306, which was passed by the House of Representatives and the Senate of the Philippines on Sept. 28, 2022.

Last month, Comelec Chairperson George Garcia said they are considering moving the dates of filing the certificates of candidacy (COC) for the 2022 Barangay SK elections pending the decision on proposals to postpone it.

The COC filing for the 2022 Barangay and SK elections was initially set from Oct. 6 to 13.

Comelec will comply

In a statement on Wednesday, Garcia said Comelec will comply with the law postponing the BSKE.

“As I have said before, the Comelec shall comply with the law. I have conveyed the Comelec position with regard to postponement of the BSKE to the legislature and the President and I trust that such position was duly noted and considered,” he said.
