Muntinlupa City Mayor asks City Council to pass ordinance to regulate electric tricycles (e-trikes)

In the progressive City of Muntinlupa, Mayor Ruffy Biazon formally asked the City Council to pass an ordinance that would regulate the use of electric tricycles (e-trikes) within the city, according to a Manila Bulletin news report. For the newcomers reading this, the Metro Manila Council (MMC) passed a resolution covering e-trikes and electric bikes (e-bikes) while the Land Transportation Office (LTO) wants the said electric vehicles to be registered.

Muntinlupa Mayor Ruffy Biazon asked the City Council to pass an ordinance regulating the use of e-trikes (electric tricycles) in the city, saying “the road is a dangerous place.”

During the flag-raising ceremony at the Muntinlupa City hall on March 4, Biazon said a local measure is needed following a resolution passed by the Metro Manila Council (MMC) that will ban e-trikes and e-bikes on 21 national roads in Metro Manila. A P2,500 fine will be imposed on violators.

Each local government unit (LGU) in Metro Manila will determine the roads in its jurisdiction that will be added to the ban.

Biazon said the MMC resolution does not include any road in Muntinlupa but the city has the National Road, which stretches from Barangay Tunasan to Sucat.

Only e-trikes will be under regulation in Muntinlupa.

“Talagang lumalaganap ang ownership ng e-trikes kasi mura nga naman, it’s a means of transportation. Madaling matutunan (The ownership of e-trikes is spreading because it’s really affordable, it’s a means of transportation. It’s easy to learn how to drive it),” said Biazon.

However, based on traffic accidents, he said, there is a growing number of incidents involving e-trikes.

Biazon said the use of e-trikes is “running out of control.” He noted that e-trikes are being driven by minors going to school.

“The road is a dangerous place. Kaya mayroong (That is why we have) road rules and regulations for safety of everyone,” he said.

Road accidents can hurt and kill people, he said. 

“The road is a dangerous place which needs regulation,” said the mayor.

“How come ang e-trike, nakikisama dun sa kalsada, sumasabay, minsan nga nagwi-weave in and out pa sa traffic, sila pa nagagalit, bakit hindi nag-a-undergo ng the same kind of regulation? ) How come e-trikes, which join the road, going along, and sometimes they weave in and out of traffic, they are even the ones who get angry, don’t undergo the same kind of regulation? They also cause traffic, they also cause accidents,” said Biazon.

He added, “At the point, kasalanan ng gobyerno na hindi kaagad naregulate o pinabayaan pa na lumaganap ang paggamit. From the very beginning dapat kinontrol na yon kasi nga we are using the road. Yan po ang position ng Metro Manila Council. (At this point, it is the fault of the government for not immediately regulating or letting its use to spread. From the very beginning, it should have been controlled because we are using the road. That is the position of the Metro Manila Council).”

“My position is clear: We need to regulate,” said Biazon, adding that the LTO is being called upon by the MMC to come up with licensing requirements for e-trike and e-bike users. 

Muntinlupa City Council Majority Floor Leader Raul Corro said they will hold a public hearing to discuss the details of the regulation in the city.

In connection with the Metro Manila Council’s (MMC) approval of a resolution affecting electric bikes (e-bikes) and electric tricycles (e-trikes), the Land Transportation Office (LTO) proposed to have all of the said vehicles to be registered and their respective drivers must be licensed to drive them, according to a GMA Network news report.

The Land Transportation Office wants light electric vehicles such as electric bikes and electric tricycles to be registered and their drivers to have licenses.

The proposal was presented by LTO chief Vigor Mendoza to stakeholders at a public consultation at the LTO office on Thursday.

In making his proposal, Mendoza cited Republic Act 4136 or the Land Transportation and Traffic Code which requires all vehicles that use public roads maintained and funded by the government whether local or national to be registered.

During the consultation, 1-Rider Partylist Bonifacio Bosita asked Mendoza if the fee for light electric vehicles could be charged half the fee of regular motorcycle registration, to which Mendoza replied that the LTO is amenable to.

Aside from registration, Mendoza said drivers who will use light electric vehicles will be required to have a license.

The Electric Vehicles Association of the Philippines (EVAP) did not pose any objection to the proposal.

On Wednesday, the Metro Manila Council and the Metro Manila Development Authority approved a resolution banning light electric vehicles on national roads and imposing a fine of P2,500. For those drivers apprehended without a driver’s license, the vehicle will be impounded.

Finally, the authorities in Metro Manila made a major move  as the Metro Manila Council (MMC) approved yesterday a resolution that specifically prohibits electric tricycles (e-trikes) and electric bikes (e-bikes) on major roads within the National Capital Region (NCR), according to a Manila Bulletin news report. That being said, the mentioned electric vehicles (e-vehicles) will finally be regulated by local authorities and their users will be required to be licensed to drive.

Mayors of Metro Manila agreed on Wednesday, Feb. 28, to ban e-scooters and e-trikes on major thoroughfares in the National Capital Region (NCR) amid rampant traffic violations and accidents involving the small electric vehicles.

The decision was stipulated in a resolution of the Metro Manila Council (MMC), composed of all Metro Manila mayors, according to MMC Chairman and San Juan City Mayor Francis Zamora during a press briefing with Metropolitan Manila Development Authority (MMDA) chairman Don Artes. 

“Why are we doing this? There were a lot of pictures and videos shown to us about accidents involving these e-trikes and e-bikes and their presence on national roads and even on expressways which show that they are not following traffic rules and regulations,” said Zamora.

“Ultimately, the objective is to regulate and impose fines for the safety of everybody especially that the number of these e-bikes and e-trikes are continuously increasing,” he added.

Artes said that while there are other local government units across the country that have already issued ordinances on the use of e-bikes and e-trikes, the missing part of these ordinances and regulations was that they do not have stipulated fines for violators.

As a matter of protocol, the implementation of the resolution will be done 15 days after its publication.

Initial list – Initially, both the MMDA and MMC identified 19 major roads in Metro Manila where e-bikes and e-trikes are banned.

They are Recto Avenue, Quirino Avenue, Araneta Avenue, Epifanio delos Santos Avenue (EDSA), Katipunan/CP Garcia, Southeast Metro Manila Expressway, Roxas Boulevard, Taft Avenue, South Luzon Expressway, Shaw Boulevard, Ortigas Avenue, Magsaysay Boulevard/Aurora Boulevard, Quezon Avenue/Commonwealth Avenue, A. Bonifacio Avenue, Rizal Avenue, Delpan/Marcos Highway/McArthur Highway, Elliptical Road, Mindanao Avenue and Marcos Highway.

Zamora, however, said that the number of roads where e-bikes and e-trikes are banned will increase in the coming days as all local government units (LGUs)( in Metro Manila were given authority to identify roads where e-bikes and e-trikes will not be allowed to travel.

Penalty – Artes said the MMC will be imposing P2,500 fine to all violators, or those who would dare to enter the prohibited roads.

He said the MMDA and enforcers of the LGUs are authorized to impose the fine on every e-bike and e-trike violator.

Artes said the same MMC resolution also authorizes traffic enforcers to impound e-bikes and e-trikes.

“If they enter the national roads we will impose a fine of P2,500. At the same time if the driver of these e-bikes and e-trikes have no driver’s license, then we will impound the vehicles,” said Artes.

Artes explained that the decision to impound the e-bikes and e-trikes was made since they could not issue a citation ticket for violation since the current regulation states that these vehicles do not need to be registered.

“Why do we have to impound them? With no registration and the driver has no driver’s license, who would receive the citation ticket?

Guidelines – Zamora, on the other hand, said they expect the Land Transportation Office (LTO) to release the guideline on Thursday, Feb. 29, on the use of e-bikes and e-trikes.

But this early, he said drivers of e-bikes and e-trikes must have a driver’s license in order to ensure that they underwent the proper training and seminar on traffic rules and regulations, as well as road safety measures.

“We consulted with the LTO to ask if the LGU has the power, and they said that if the e-trikes and e-bikes are not registered and the drivers do not have a driver’s license, then these are already two violations,” said Zamora.

Artes, for his part, said they expect the LTO guideline to discuss and clear things up on registration and the driver’s license requirement for riders of e-bikes and e-trikes.

In recent times, a lot of people have spotted electric bikes (e-bikes) and electric tricycles (e-trikes) traveling on national roads – including the South Luzon Expressway (SLEX) – and posted images of them online. That being said, the local authorities could not ignore the many complaints of these electric vehicles (EVs) and they will respond by issuing a new guideline soon, according to a Manila Bulletin news report.

Viral videos of complaints against e-bikes and e-trikes , including an elementary pupil driving one of them on a national road and their presence on major thoroughfares that include the South Luzon Expressway (SLEX), have prompted national government agencies to expedite the finalization of the rules and regulations that would govern both their ownership and use.

On the side of the Land Transportation Office (LTO), its chief, Assistant Secretary Vigor D. Mendoza II, said two of the measures that would be included in the recommendation they would submit to the Department of Transportation is for the registration of the e-bikes and e-trikes before the agency.

E-bikes and e-trikes are not required to be registered similar to motor vehicles and this is actually the major marketing strategy of its sellers, according to Metropolitan Manila Development Authority (MMDA) chairperson Don Artes.

Aside from registration requirements, Mendoza said they will also include in the recommendation the issue on whether or not the users of e-bikes and e-trikes will be mandated to obtain a driver’s license.

Artes, again, said the non-requirement of a driver’s license to drive them is another selling point of the e-bikes and e-trikes.

According to Mendoza, another argument that will be included in the recommendation is the total ban of e-bikes and e-trikes not only on national roads but also on major thoroughfares and even public roads, particularly the busy ones.

“The guideline (on e-bikes and e-trikes) must be released within this month because a publication of it is still needed before the implementation,” said Mendoza in a press briefing at the MMDA office in Pasig City on Thursday, Feb. 15.

“So we should be able to submit our recommendations to the Secretary (DOTr Secretary Jaime J. Bautista) within this week so that everything will be finally ironed out,” he added.

Exponential growth – Asked if the national government has a data on how many e-bikes and e-trikes in the country, Artes said they do not have the figure simply because there is no source of credible information since e-bikes and e-trikes are not required to be registered.

Artes, however, said that in Metro Manila alone, they have been seeing an exponential growth on the number of e-bikes and e-trikes.

But in Caloocan City where an ordinance was passed for the mandatory accounting of e-bikes and e-trikes, Artes said the figure is at around 18,000.

“So in just one LGU (local government unit) here in Metro Manila, there were already 18,000. So you can just imagine using the fact there are 17 LGUs here in Metro Manila. For sure, there are plenty of them,” said Artes.

“This is really concerning in terms of road safety because they are using roads, especially major roads, and some of the users do not even have the idea of basic road regulations that may cause accidents. So it’s about time that we come up with regulations on this matter,” he added.

E-bikes accident data – Based on the data released last month by the MMDA, a total of 556 road accidents were recorded in Metro Manila involving e-bikes and e-trikes from January to November last year.

There were two reported fatalities recorded in the same period—one was reported in February last year while the other one was reported in August last year.

The same data revealed that e-bikes and e-trikes accidents resulted in 282 non-fatal injuries and 281 cases of damage to property.

Enforcement difficulties – Artes admitted that their enforcers on the roads are having difficulty dealing with e-bikes and e-trikes. For one, they could not issue a citation ticket for traffic violation since the riders have no driver’s license in the first place.

Another one is that they could not also impound the e-bikes and e-trikes due to the absence of a guideline that would legally allow the MMDA to do so.

Consolidation of policies – Artes said there are a number of local government agencies which came up with guidelines on the use of e-bikes and e-trikes, one of them is their use for livelihood by allowing e-trikes to be used as public utility vehicles.

On the part of the national government, Mendoza said they will come up with a guideline that would be nationwide in scope in coordination with local government agencies and other stakeholders.

This is the reason, he said, why they have been continuously meeting even with representatives of groups advocating e-vehicles.

“The guideline that will be issued will be nationwide on scope. So it is important that coordination with LGUs and other stakeholders is important,” said Mendoza.

For road safety – Both Artes and Mendoza said that the guidelines that will be issued by the national government are purely aimed at ensuring the safety of all road users, including the riders of e-bikes and e-trikes.

To make things clear, e-bikes and e-trikes have been around for many years now. When someone travels along a major road or even on the highway using an e-bike or e-trike, he or she adds to the danger on the road. There were 556 e-bike crashes in Metro Manila in 2023 and e-trikes were clearly not designed to be safe nor stable. While the Land Transportation Office (LTO) is taking so long to execute any solid action, more e-bikes and e-trikes are spreading around and some of them were even driven by minors. The Department of the Interior and Local Government (DILG) reminded local governments to ban tricycles and pedicabs on national roads and highways.

Recently in the progressive City of Muntinlupa, electric tricycles (e-trikes) became a topic of concern for one member of the City Council, according to a Manila Bulletin news report. The City Councilor clarified that any regulation covering e-trikes will be discussed in a public hearing that will be conducted by the legislative body.

A member of the Muntinlupa City Council has proposed to regulate passenger e-trikes (electric tricycles) amid the growing number of the vehicles plying the national road.

During the City Council’s regular session on Jan. 29, Councilor Ryan Bagatsing expressed concerns about the safety of e-trikes, which are currently not required to register with the Land Transportation Office (LTO).

He is also concerned that some e-trike users are not following traffic rules and overloading.

In an interview with Manila Bulletin, Bagatsing said the use of e-trikes should be regulated in Muntinlupa.

Bagatsing noted that road accidents have happened involving e-trikes. He is also concerned that in some cases, these electric vehicles are driven by minors.

He is proposing that all e-trikes should be registered with the city government to identify the owners, users and drivers.

“It’s the same thing with what we are doing with fishing boats. These have body numbers to identify the users. We really need to come up with some regulations,” he said.

Another issue is e-trikes using the national road in Muntinlupa. Currently, tricycles in Muntinlupa are banned from using the national road, a long stretch of road from Barangay Tunasan to Sucat.

Motorists have complained that e-trikes have become hazards on major roads in the country.

Summer is only getting hotter here in the Philippines and there have been rounds of water service interruptions that added to the inconveniences of families and businesses. In Metro Manila, the mayors will be meeting soon to discuss key proposals to temporarily halt business and activities that consume a lot of water, according to a Manila Bulletin news report. The head of the Metro Manila Council (MMC) Mayor Francis Zamora, however, stated the possible regulation of water use which will involve the issuance of guidelines.

San Juan City Mayor and Metro Manila Council (MMC) President Francis Zamora said he will call for a meeting with other Metro Manila mayors to tackle the Manila Waterworks and Sewerage System’s (MWSS) proposal for local government units (LGUs) to temporarily ban businesses and other activities with high water consumption such as car wash stations and the use of inflatable pools in a bid to conserve water in preparation for the expected “strong” El Niño phenomenon.

“Magpapatawag po tayo ng pagpupulong kasama ang mga Metro Manila mayors para pagusapan ang mga bagay at hakbang na pwede nating gawin upang siguraduhin nga po na maregulate natin ang pag-gamit ng tubig ng mga establisyimento na malakas ang konsumo bunsod na rin po ng mararamdaman nating epekto ng El Niño sa mga darating na linggo o buwan (We will call for a meeting of the Metro Manila mayors to discuss the steps that we will take to ensure a regulated water use of establishments that have high water consumption amid the expected strong El Niño in the coming weeks or months),” Zamora said in a radio interview.

“Aaralin natin yung mga posibilidad. Yung mga nabanggit, these are (some of the) many possibilities that we can do. It is more of regulating the use kasi yung total ban naman, eh hindi naman natin agad agad masasabi ngayon na “o itigil nyo ito, i-ban yung ganito. We can regulate the use. Regulate means talagang magbibigay tayo ng mga panuntunan or guidelines sa kung ano ba ang pwedeng gawin (We will look at the possibilities. Those that we have mentioned, these are just some of the possibilities that we can do. It is more of regulating the use because it is impossible for us to immediately declare that these activities should be banned and must be stopped. We can regulate the use. Regulate means we really are going to issue guidelines),” he added.

The mayor stressed that despite the urgency of the matter, the MMC and all concerned agencies of the government must think about the livelihood of those who will be affected by the said proposal.

“We have to identify ano ba yung mga establisyimento na we consider talaga na malakas ang konsumo ng tubig. Necessary ba yung mga yan? Kailangan ba magbawas? On Wednesday, April 26, MWSS Deputy Administrator for Engineering and Technical Operations Group Jose Dorado Jr. identified car washes and the use of inflatable pools as high water consuming activities and said that the regulation of such activities and businesses should only be done by the local government units (LGUs) when the water level in dams becomes critical.

COMELEC says vote-buying is still an election offense

The topic of vote-buying is back in the minds of voters here in the Philippines mainly due to the recent statement made by a certain politician (for reference, click here and here) running for President next year. This prompted the Commission on Elections (COMELEC), which is already busy processing voter registration applications with the October 30 deadline approaching, to remind people that vote-buying is still an election offense and clearly punishable by law.

To put things in perspective, posted below is an excerpt from the Manila Bulletin news report. Some parts in boldface…

Vote buying is an election offense regardless of financial situation or noble intentions.

Commission on Elections (Comelec) Spokesperson James Jimenez issued this reminder on Wednesday, Oct. 27.

He also disagreed with the advice of Vice President Leni Robredo for voters to accept the money but vote according to their conscience.

“I disagree with the notion of taking the money and voting according to your conscience,” Jimenez said on Twitter.

He added:”Di dapat ginagawa, at di dapat sina-suggest yan sa mga botante (It shouldn’t be done, and shouldn’t be suggested to our voters),”

Last August, Comelec Commissioner Rowena Guanzon warned those who will try vote buying via the electronic payment system in the May 2022 polls that this can be traced.

“This is a warning to politicians, know that you’re going to be found out,” she said.

Vote-buying is defined as any person, who gives, offers, or promises money or anything of value, directly or indirectly, in order to induce anyone or the public in general to vote for or against any candidate.

The above report ended stating that as an election offense, vote-buying means getting yourselves penalized with 1 to 6 years imprisonment, the removal of your right to vote, and disqualification to hold public office.
