SOSIA issues advisory on the confiscation of driver’s license by security guards

Hey readers! Has any security guard confiscated your driver’s license in recent times? The latest news and details below deserve your attention.

The Supervisory Office for Security and Investigation Agencies (SOSIA) issued on June 15 a new advisory signed by Acting Chief Police Colonel Sidney N. Villaflor regarding the confiscation of driver’s license by security guards. This is pursuant to Republic Act Number 4136 (An Act to Compile The Laws Relative To Land Transportation and Traffic Rules, To Create a Land Transportation Commission and For Other Purposes) regarding the power to secure and/or confiscate drivers licenses are lodged under the capacity of LTO personnel and others who are duly deputized by the said Agency.

Below for your viewing and reading is the picture of the June 15, 2020 advisory from SOSIA.

Item #2 on the advisory states as follows: This pertains to incidents wherein security guards deployed in private villages and subdivisions require the drivers of vehicles to surrender their driver’s licenses prior entering the premises, as directed by the Home Owners Associations’ (HOAs’) leadership.

Item #3 makes clear that the power to secure and/or confiscate driver’s licenses are lodged under the capacity of personnel of the Land Transportation Office (LTO), and others who got deputized by the said Agency.

Item #4 is the hot one and it makes clear who or what organizations do NOT have any authority to confiscate driver’s licenses. It reads as follows: the HOAs and the security guards of subdivisions, villages and condominiums are not authorized under traffic laws to take custody, even on a temporary basis, the license issued by the LTO.

For more insight, Section 29 of RA 4136 states as follows:

Confiscation of Driver’s License.Law enforcement and peace officers of other agencies duly deputized by the Director  shall, in apprehending a driver for any violation of this Act or any regulations issued pursuant thereto, or of local traffic rules and regulations not contrary to any provisions of this Act, confiscate the license of the driver concerned and issue a receipt prescribed and issued by the Bureau  therefor which shall authorize the driver to operate a motor vehicle for a period not exceeding seventy-two hours from the time and date of issue of said receipt. The period so fixed in the receipt shall not be extended, and shall become invalid thereafter. Failure of the driver to settle his case within fifteen days from the date of apprehension will be a ground for the suspension and/or revocation of his license.

Item #5 clarifies that drivers of vehicles entering the above stated properties may present to the security guards any valid ID cards issued by the government. As such, the security guards are supposed to be professional in their work while being courteous to everyone.

Here in South Metro Manila, the cities of Parañaque, Las Piñas and Muntinlupa have a lot of subdivisions or villages combined. From time to time, I saw written feedback by other uses on social media that some incidents occurred in which drivers trying to enter a village had no choice but to surrender the driver’s license because other government-issued ID cards (example: COMELEC ID card) were not accepted by the security guard at the gate.

Now that the SOSIA June 15, 2020 advisory above makes clear that HOAs and security guards are not authorized to confiscate driver’s licenses at all, drivers are more protected. In fact, Section 19 of RA 4136 specifically states:  The license shall be carried by the driver at all times when operating a motor vehicle, and shall be shown and/or surrendered for cause and upon demand to any person with authority under this Act to confiscate the same.

So there you have it, my readers, SOSIA’s June 15, 2020 advisory is a big reminder when it comes to the driver’s license and encountering security guards.

As people around Luzon slowly adjust with the GCQ (General Community Quarantine) in effect for almost a week now, the police officers of Las Piñas City continue to perform their duties diligently.

Recently the Las Piñas City Police Station led by PMAJ ALLAN MERCADO, C, SCADS/PIO under the supervision of PCOL SEGUNDO C LAGUNDI JR., COP conducted the operation called Online Dalaw. To put things in perspective, Online Dalaw was designed to help Persons Deprived of Liberty (note: those who are under custody of the police) ease the worries of their families who could not visit them due to the ongoing COVID-19 pandemic. Apart from Online Dalaw, the police force continued to perform helpful public service by doing good deeds. On the morning of June 5, they provided free transportation to some locals. That same morning, at another location, the police distributed relief goods to a family that needed them.

COVID-19 Crisis: Filinvest City Foundation donates over two thousand rapid test kits to Muntinlupa City Government

Recently the Filinvest City Foundation emphasized its generosity and care by donating two thousand and ten (2,010) of rapid test kits to the City Government of Muntinlupa. The donation was meant to augment the city’s mass testing efforts.

The donation was formally done on May 22 at the office of Mayor Jaime Fresnedi who expressed his gratitude to the foundation which was represented by its general manager Arch Lui Lava. Also present during the receiving of the rapid test kits were City Health Officer Dra. Teresa Tuliao, City Administrator Engr. Allan Cachuela, and Local Economic and Investment Promotion Officer Gary Llamas.

COVID-19 Crisis: 4,174 tricycles in Muntinlupa City now allowed to operate amid MECQ

Over four thousand tricycles in Muntinlupa City have been allowed to operate and transport authorized passengers provided that they follow sanitary measures amid the modified enhanced community quarantine (MECQ).

Traffic Management Bureau chief Danidon Nolasco stated that the resumption of tricycle operations in the city starting May 25 aims to help at least 4,174 tricycle drivers who have renewed their permits.

Nolasco said tricycle drivers can only transport frontliners, workers of industries allowed to operate during MECQ, and heads of households buying essential goods to limit people’s movement.

An odd-even scheme will be implemented and tricycles can only operate from 5:00 AM – 12:00 MN.  MTMB has already distributed 2,761 official stickers and quarantine passes to tricycle drivers from 26 TODA.

The local traffic chief reminded tricycle drivers that the prohibition in entering highways and national road is still in effect, except for emergency health cases. Further, cross-over trips are not allowed, except for Rizal St. (Poblacion) and Bautista (Bayanan).

Only one passenger per tricycle will be allowed with an exemption for emergency cases. Due to limited passenger load, each trip will be considered a “special trip” and will amount not exceeding P25.00.

A transparent plastic sheet barrier shall be installed in tricycles to avoid physical contact. Tricycles are to be disinfected at least twice a day and must have alcohol-based sanitizers. Drivers and passengers must wear face masks at all times.

Mandatory temperature check will be conducted and disinfecting facility with soap and water, or sanitizers, will be made available in local terminals.

Tricycle drivers found in violation of the guidelines will be penalized with P1,000 for first offense, P2,000 for second offense, and revocation of permit for third offense.

Muntinlupa Mayor Jaime Fresnedi has approved Executive Order No. 15 s.2020 allowing the resumption of tricycle operations in the city during MECQ.

The resumption of tricycle operations in Muntinlupa is in accordance with the recommendation of Muntinlupa Traffic Management Bureau and Omnibus Public Transportation Guidelines as approved by the Department of Transportation.

COVID-19 Crisis: Tricycles to resume operation in Muntinlupa starting Monday amid MECQ as conditions apply

Starting Monday (May 25) tricycles in Muntinlupa City will be allowed to transport authorized passengers provided that they follow sanitary measures amid the modified enhanced community quarantine (MECQ).

Mayor Jaime Fresnedi approved Executive Order No. 15 s.2020 allowing the resumption of tricycle operations in the city during MECQ.

The resumption of tricycle operations in Muntinlupa is in accordance with the recommendation of Muntinlupa Traffic Management Bureau and Omnibus Public Transportation Guidelines as approved by the Department of Transportation.

Tricycle Operators and Drivers Associations (TODA) will implement an odd-even scheme where all members with Tricycle Regulatory Unit (TRU) numbers ending in an odd digit will be allowed to operate on M-W-F schedule, while those with TRU numbers ending in an even digit will be allowed on T-Th-S schedule.

TODA members are not allowed on Sundays and may only operate from 5:00 AM – 12:00 MN.

Tricycle drivers must install transparent plastic sheet separating the passenger cab and driver to avoid physical contact. Tricycles are to be disinfected at least twice a day and must have alcohol-based sanitizers.

One passenger per tricycle will be strictly followed with an exemption on emergency cases. Due to limited passenger load, each trip will be considered a “special trip” and will amount not exceeding P25.00.

Passengers allowed to board on tricycles include essential workers, frontliners, workers of allowed industries, and heads of households buying essential goods provided that they present quarantine pass and valid ID.

A mandatory temperature check will be conducted in terminals. Disinfecting facility with soap and water, or sanitizers, must also be made available. Tricycle drivers and passengers are mandated to wear face masks at all times.

MTMB-TRU will conduct random inspections to validate the compliance of TODAs. Tricycle drivers found in violation of the guidelines will be penalized.

Muntinlupa City recorded the highest COVID-19 recovery rate in Metro Manila at 56.85% as of May 16. Further, COVID-19 transmission in the city is slowing down with a doubling time of eight days.

Fresnedi said the City Government will implement more stringent quarantine measures and will not be complacent amid MECQ and with the high recovery rate among Muntinlupa’s COVID-19 cases.  The local exec reminded city residents that they should continue to observe physical distancing and wear masks when going out of their homes.

Muntinlupa City has 205 confirmed cases with 127 recoveries, 48 active cases, 30 reported deaths, 21 suspect cases, and 195 probable cases as of May 21.
